High Court blocks Matiang’i from renewing Fazul’s tenure as NGO Board head

Acting Interior Cabinet Secretary Dr Fred Matiang’i has been temporarily blocked by the High Court from renewing the tenure of NGO Coordination Board Executive Director Fazul Mohammed.

This is in light of a petition lodged with the court by activist Okiya Omtatah who had earlier challenged Fazul’s legality in office.

Omtatah in his petition argued that Fazul’s tenure expired on November 23.

He also cites that the CS has not commenced the process of competitively re-appointing Fazul or seeking a replacement for him which should be done by July 24.

Employment and Labour Relations judge Hellen Wasilwa on Wednesday certified the case as urgent.

She ruled that the Acting Interior CS cannot renew the tenure for the NGO Board Executive Director until Omtatah’s case if heard and determined.

In the past months, Fazul has been a force to reckon with in the NGO sector.

Some political players especially in the opposition have branded him a “Jubilee puppet”.

He has shut down several NGOs, all believed to be having links with the opposition or with the Judiciary.

His first storm was when he de-registered the Kalonzo Musyoka Foundation-linked to Wiper Party boss Kalonzo Musyoka.

He later did the same to another NGO linked to NASA leader Raila Odinga’s last born daughter Rosemary Odinga.

He claimed the foundation was receiving money from George Soros Foundation in the US to sabotage government.
