It’s not over yet, says Babu Owino, vows to appeal

It is not over yet, Embakasi East MP Paul Ongili alias Babu Owino has said after nullification of his election.

The High Court in Nairobi on Friday nullified his election citing poll irregularities.

In his ruling, Justice Joseph Sergon said in light of the evidence before the court, he is inclined to state that the elections in the constituency were not free and fair.

“Considering all the evidence tendered before me, I find that elections in Embakasi East were not free and fair as the entire process was dotted with violence occasioned by the voters and supporters of Mr Owino,” Said Justice Sergon in his ruling according to Nairobi News.

He ordered Babu and the IEBC to pay a sum of Sh5 million in costs to the petitioner-Francis Mureithi.

Mureithi in his case outlined instances intimidation and violence instigated by Babu at the constituency tallying centre which goes against the elections laws.

He also cited that there was a discrepancy in the IEBC data which may have given Babu an undue win.

However, the former University of Nairobi Students’ leader said he would appeal the ruling at the Court of Appeal.

He said that should there be an eventuality of going back to the ballot, he is optimistic he will still clinch the seat.

“I’m sure of winning the repeat polls even if it will be a contest between me and the top leadership of Jubilee Party,” he said.

He also cast aspersion on President Uhuru Kenyatta and his Deputy William Ruto alleging they influenced the court’s decision.

“I would like to state clearly that the whole nation knows what happened. The whole nation knows that this is a war between Babu Owino and President Uhuru Kenyatta and Deputy President William Ruto,” charged the MP according to Citizen Digital.

“The whole nation knows that I have been highly critical of the president and his deputy. It is sad that the Executive is using its influence to arm-twist the Judiciary. What can’t kill you, can only make you stronger. If Uhuru and Ruto decide to come and vie in Embakasi East, I will beat them yesterday in the morning,” he added.
