Judge bars police from arresting Orengo, Joho over Raila Oath

The High Court on Tuesday barred the Director of Public Prosecution and the police from arresting and prosecuting 12 NASA leaders over Raila Odinga’s unofficial inauguration.

The politicians include Siaya Senator James Orengo, Makadara MP George Aladwa, Dagoretti North Simba Arati, Vihiga Senator George Khaniri, businessman Jimmy Wanjigi, NASA CEO Norman Magaya, and Homa Bay Women Representative Gladys Wanga.

Others are David Ndii, Babu Owino, Oduor Ong’wen, Kakamega Senator Cleophas Malala, and Mombasa Governor Hassan Joho.

Justice Luka Kimaru granted each of them anticipated bail of Sh100, 000. The Judge ordered them to present themselves before the DCI on Thursday at 11am.

Through their lawyer Nelson Havi, the 12 NASA politicians told the court that they are willing to present themselves in a fair and just judicial system.

They said police’s intention is to harass, torture, mistreat and intimidate them which is why they applied for anticipatory bail.

“Our apprehension is that the primary motive is to oppress and even fatally harm, injure or kill us,” they said in their application according to the Star.

Their fears, they say, have been inspired by the horrifying ordeals their colleagues TJ Kajwang and Miguna Miguna have undergone in the hands of the police.

However, the National Police Service Commission in a tweet on Tuesday said the politicians who applied for anticipatory bails are not people of interest in the oath crackdown.

“Those individuals should, therefore, not bother turning up at the DCI offices. They are not persons of interest to the police as of now,” read the tweet.
