Maraga accused of favouring NASA by Uhuru’s Jubilee Party

Jubilee Party led by President Uhuru Kenyatta has written a letter to the Chief Justice David Maraga accusing the Judiciary of more than once, favouring the opposition.

According to the Standard, JP Secretary General Raphael Tuju detailed seven instances in the three-page letter highlighting seven instances where the Judiciary purportedly showed favoritism to NASA.

This, Jubilee says, shows lack of proper leadership by Maraga, impunity and double standards.

Tuju told Maraga that the Judiciary was being controlled by NASA and Raila Odinga’s ODM Party as well as “”cartels of tenderprenuers who were bleeding the country by aiding fraud”.

“I state the following not to provoke you but to submit that no power is absolute, for the Judiciary, executive or legislature, irresponsible actions from Judiciary, executive or legislature can burn the country, with all due respect you almost burned the country after the elections of August 8 2017,” said Tuju as further quoted by the Standard.

In one of the instances, Tuju cited the ruling issued by the Supreme Court when Jubilee sought the court’s intervention after Raila Odinga withdrew from the October 26 repeat presidential polls.

He accused the apex court of issuing a post facto date which denied Jubilee a hearing on the matter.

“The Supreme Court saw nothing urgent with this petition to the court, and gave a hearing of October 27th, a post defacto date. This was like a naughty wink to NASA to continue with their contempt of the Supreme Court,” he noted.

Tuju further said that despite the court upholding Uhuru’s win in the repeat polls, NASA defied court orders and went ahead to inaugurate Raila as the People’s President.

He said Maraga failed to offer leadership to the Judiciary days to the unofficial swearing-in of Raila saying every Judge that every judge had  was at liberty to rule the way they deemed fit for cases before them.

“I sincerely hoped that you were misquoted otherwise this would have been taken to be another wink at NASA to continue with their nonsense,” added Tuju in the letter to the CJ.

This comes after President Kenyatta nominated three new members to the Judicial Service Commission, a move seen as a fulfillment of his pledge to “revisit” the Judiciary after annulment of August 8 polls.

Uhuru nominated former Agriculture Cabinet Secretary Felix Koskei, former National Assembly clerk Patrick Gichohi and former Kenyatta University Vice-Chancellor Prof Olive Mugenda.

Gichohi has been nominated to fill the position of Public Service Commission Chair which fell vacant upon the nomination of Prof Margaret Kobia and Public Service, Youth and Gender CS.

Koskei on the other hand will replace Kipngetich Bett who has been serving as a commissioner in JSC representing the public appointed by the President with the approval of the National Assembly.
