The state is yet to withdraw gun charges against billionaire businessman Jimmy Wanjigi and his father Maina Wanjigi fondly referred to as Wanjigi Snr, the court heard on Thursday.

Prosecutor Wesley Nyamache told Nyeri Chief Magistrate Wendy Kagendo that he is yet to receive any instructions from the DPP to drop the charges against the Wanjigi’s.

Nyamache said he intends to continue prosecuting the case until the DPP instructs him otherwise.

But Wanjigi’s lawyer Kiogora Mugambi told the court that DCI officers at the headquarters located along Kiambu Road had hinted to him the state was dropping the case.

He said he had been told that by March 15 this year, the cases against the two would be dropped.

“I came expecting that all charges against Jimi Wanjigi and associates would be withdrawn. However, the case will not be dropped,” said lawyer Mugambi for Wanjigi according to Daily Nation.

He added: “I found that the State has recalled the decision and are keen to pursue the case but we are ready to face them.”

Jimmy faces 11 counts of importing a prohibited firearm while his father, Wanjigi Snr faces a separate count of failing to keep his firearm in safe custody.

This comes amid a deal struck during a meeting last week on Friday between President Uhuru Kenyatta and opposition leader Raila Odinga.

After the meeting, it was agreed that the gun-related cases against the Wanjigi’s would be dropped.

Further, that the tycoon’s passport which had been confiscated by the immigration department would be returned.
