Supreme Court verdict: Chebukati cannot make changes to poll result forms

The Independent Electoral and Boundaries Commission (IEBC) chairman Wafula Chebukati cannot correct errors in result forms during the repeat polls, Supreme Court has ruled.

In a majority ruling delivered by Deputy Chief Justice Philomena Mwilu on Tuesday, the apex court upheld an earlier ruling by the Court of Appeal.

And in concurring judgment read by Justice Prof Jackton Ojwang, poll results announced at the Constituency level will be final.

Should there be errors in Forms 34A and 34B, then, the matter should be left to the Courts to solve it, the Judges pronounced themselves on the matter.

Chebukati moved to the Supreme Court seeking directions on the issue ahead of repeat polls slated for October 26.

This is after the Supreme Court in a full judgment on why a majority of the judges nullified the polls indicted him.

The ruling suggested that he should have verified result forms before announcing the winner of the Presidential election.

But Chebukati argued that his hands were tied by the Appellate Court ruling which ruled that no alteration should be made on the result forms.
