Tobiko orders Raila, Kalonzo prosecution over election boycott threat

NASA Principals Raila Odinga and Kalonzo Musyoka could be prosecuted for poll boycott threat.

This follows an order by the Director of Public Prosecution (DPP) Keriako Tobiko to have the two opposition leaders investigated and prosecuted.

Tobiko’s directive was informed by a petition filed by Samuel Waweru through Harrison Kinayanjui & Co. Advocates.

Raila and Kalonzo will be investigated and prosecuted over their utterance that there will be no elections on October 26.

NASA maintains that IEBC must address 12-point “irreducible minimums” which among other things is calling for IEBC CEO Ezra Chiloba’s resignation.

Failure by IEBC to address this, opposition has adamantly stated there will be no repeat polls on the 26th of October.

The opposition also notes that reforms at the IEBC are wanting for a credible Presidential election to be conducted.

In a letter to DCI boss Ndegwa Muhoro dated October 2, Tobiko said the two leaders should be investigated for contravening Section 132 of the Penal Code.

He has given the DCI boss 21 days to complete the investigations.

“I call on the DCI to undertake thorough comprehensive and expenditure investigations,” said the DPP in his letter as reported by the Star.

He adds: “I have also designated a team of senior prosecutors to provide technical guidance and assistance to investigating teams.”

In a consultative meeting with the IEBC earlier this week, NASA through Raila’s point man and Siaya Senator James Orengo said their concerns have not been addressed.

Orengo categorically said IEBC has not responded to the issues they raised let alone addressing them.

But IEBC Chair Wafula Chebukati without divulging further details said they have addressed some of the concerns raised by NASA.
