Two Nigerian nationals currently studying at USIU Africa University have moved to court to block their deportation for being in the country illegally.
Together with a Kenyan woman, Euphrasia Atieno, the Nigerians-Olamilekan Gbenga and Oluwaseyi Richard through their lawyer Charles Midenga asked the court to quash orders issued by director of Immigration services to deport them on September 8, 2017.
The lawyer also wants the court to quash order by the directorate of Immigration placing Gbenga and Oluwaseyi on the immigration watch list as communicate to them on diverse dates between November 14, 2017, January 23 and March 19, 2018.
Midenga told the court that his clients are currently pursuing degree courses in international business administration.
They have been in Kenya on a student’s pass issued on March 29, 2017, for one year and was to expire on March 20, this year.
He argued the immigration office seeks to deport his clients without an arrest warrant or deportation order.
Lawyer Midenga also said that the director of the immigration department unreasonably demanded for Sh200, 000 so as to release the vehicle to Atieno who is Gbenga’s wife.
“While so doing, the applicants were neither allowed an opportunity to be heard nor legal representation as their attempts to seek legal representation were thwarted by the arresting officers who seized their mobile phones and their motor vehicle”, Lawyer Midenga said according to the Star.
“The 1st and 2nd applicants impugned deportation has gravely affected their studies and occasioned great economic hardship, anguish and emotional distress to their families”, he added.
Since the move by the state to deport them was first made, they have been denied the opportunity to attend classes.
The case will be heard on Wednesday for inter-party hearing.
