President Uhuru Kenyatta’s nephew-cum-his personal assistance Jomo Gecaga is fighting an eviction pitting him against former Nairobi Governor Evans Kidero.

Gecaga has been running JSTA Ltd located at Gem Suites in Riverside Nairobi. JSTA is a company associated with his father Udi Gecaga and pays monthly rent of Ksh540,000 which was halved to Ksh240,000 between June and September due to coronavirus pandemic.

The apartment owned by Kidero’s Geminvest Limited has sent an eviction notice to JSTA failure demanding that it settles a debt of Ksh900,000 already owed and thereafter, move out.

Failure to do this Geminvest has contracted an auctioneer to auction JSTA, a move that had the Gecaga’s seek the court’s intervention by blocking the eviction and auctioneers.

“We therefore request that you pay the outstanding amount of Sh950,000, renovate and paint the apartment as you found it at the beginning of Jomo Gecaga occupancy on 28th March 2014 then handover the apartment not later than 30th September 2020,” said Geminvest in a termination notice sent to JSTA.

In court papers, reports Business Daily, JSTA argued that it “will be seriously prejudiced and suffer untold loss and damage not to mention the embarrassment.”

Gecaga argued that he had requested the Kidero’s to extend the period of halved rent through to December citing that business has not been doing well due to COVID-19 pandemic.

However, Geminvest accused Gecaga of refusing to sign a new lease agreement after the previous one elapsed in 2016.

“Geminvest Limited will not accept payment of Sh250,000 only as monthly rent,” the company said in a September 15 notice attached in court documents.

“The company requests that you clear current outstanding bill of Sh950,000 for period ending September 30 and then vacate the unit.”
The case has since been certified as urgent by Senior Principal Magistrate Agnes Makau. It is set for hearing on October 6.

In response to the suit, Geminvest said that in March, Jomo’s father Udi who is the proprietor of JSTA limited had asked the Kidero’s for relief when business was completely down.

He asked the company associated with Kidero to draw its rent for February and March from Sh1 million which he had paid as a deposit for the apartment where his son Jomo lives.
