Two ex-cops who were recently convicted of manslaughter following the death of Janet Waiyaki at City Park in 2018 have asked for leniency.
On Thursday, Godfrey Kirui and William Chirchir appeared before Justice Stella Mutuku and asked the court for a non-custodial sentence.
They told the court that they regret the incident at City Park on the fateful Sunday morning and they now know they could have made better judgment other than opening fire on the vehicle.
Janet, then 41 years old died leaving behind three children the firstborn aged 12.
In his defence, Chirchir, 36, told the court that he has two kids to look after and an elderly mother who he takes care of.
On his part, Kirui, 28, told the court that he is a father of two and he is the sole breadwinner for the family.
The Prosecution team told the court that the two ex-cops took away life without considering that she was a mother.
“The children will live the rest of their lives without the care of a mother. The young one has been waiting for the mother to come back,” the court was told.
Police reports after the incident happened indicated that they found the deceased with her nephew in a “compromising situation” and that officers shot at the Toyota Fielder car registration number KBX 515H after the occupants defied orders to open the doors and sped off.
A report sent to police headquarters by Parklands police boss Chief Inspector Moses Shikuku read that: “They knocked on the tinted windows, but there was no response and all of a sudden, the vehicle sped off towards the road.”
“The vehicle then stopped and inside were a male and a female namely Bernard Chege, 26 years old and Janet Wangui Waiyaki aged 41 years. They had gunshot wounds.”
Both were rushed to Avenue Hospital in Parklands by Waiyaki was pronounced dead on arrival.
The court will sentence them on May 28.
