Stop intimidating the Judiciary, CJ Maraga tells Uhuru, Raila, Duale

Chief Justice David Maraga has accused President Uhuru Kenyatta and NASA leaders, Raila Odinga and Kalonzo Musyoka of intimidating the Judiciary.

On July 9, Uhuru together with his Deputy William Ruto accused Judiciary of delivering rulings in favor of NASA.

This is after the High Court halted the printing of Presidential ballot papers by Dubai based printing firm Al Ghurair.

High Court Judge Odunga delivered the ruling before asking the CJ to constitute a three-Judge bench to hear the case challenging awarding the tender to Al Ghurair.

On the other hand, Raila and Kalonzo had declared to demonstrate should the Court of Appeal rule that Presidential results announced at constituency level was not final.

They made the remarks on July 9 too.

In a tirade, Maraga also roped in National Assembly Majority Leader Aden Duale for advancing attacks on Judiciary.

In December last year, Duale launched an onslaught against High Court Judge George Odunga accusing him of playing tribal politics.

He said the Judge was favoring the opposition at the time by issuing orders allowing them to demonstrate in the push to have former IEBC commissioners leave office.

Maraga also pointed an accusing finger on Devolution Cabinet Secretary Mwangi Kiunjuri and Kinango MP Gonzi Rai as other politicians who have attacked the Judiciary in the past.

The two faulted the CJ for appointing Justice Odunga in a three-Judge bench that heard a petition challenging the awarding of ballot printing tender to Al Ghurair.

Terming the attacks on Judiciary by the political class as bolder, persistent and Institutionalized, Maraga said this is abuse of the law.

“The tone and regularity of the condemnations transgress the ordinary boundary of disagreement and debate on Judicial pronouncements and lurch alarmingly in the direction of threats, intimidation, and blackmail,” he said in a statement.

He said this trend must stop.

He also hit out at Jubilee Party over a letter they wrote requesting not to have some Judges hear election petition due to “conflict of interest”.

But Maraga responded saying the party has no power to select who hears the cases.

And with his response, Jubilee Party Deputy Chair Veronicah Maina criticized the CJ for responding to their concerns through the media.

“The CJ addressed Jubilee Party from the media. What Jubilee was looking for was fair playing field… So is that approach correct or not correct? Is that the way it should be responded to?” she asked on Thursday during an interview with NTV.
