Hard questions for Supreme Court as Uhuru seeks answers on “irrational” majority judgment

Just a day after the Supreme Court gave a full judgment on why it nullified August 8 polls, pertinent questions from the ruling coalition have emerged.

During a State House address to pastoralists’ communities on Thursday, President Uhuru Kenyatta asked the Court to explain how they overturned his victory yet they did not scrutinize evidence brought forward.

A visibly frustrated President questioned why majority of judges who overturned his win never combed through critical evidence before them but passed their judgment based on an assumption.

“We have been informed that due to time constrains, they did not peruse through the volumes of documents that were presented,” said Uhuru.

“How a decision of that magnitude was arrived at without examination of crucial documents remains a mystery,” added he.

He said that if the judges took time and analyzed critical evidence, perhaps, the outcome of the case could have been different.

“If only they did, it would have brought the bench to an alternative decision that the vote was valid.”

“The Supreme Court, therefore, owes Kenyans an explanation on how such a decision took place,” stated Uhuru.

In a majority decision, four judges out of six nullified the August 8 polls on grounds it was marred by illegalities and irregularities which is against the dictates of the Constitution.

Only Justices Njoki Ndung’u and Jackton Ojwang were of a dissenting view saying evidence brought before the court did not meet the threshold to nullify the polls.

Uhuru added that I will always remain the will of Kenyans who voted on August 8 was subverted.

“Voting, counting and tallying was done in accordance with the law. Number of votes cast as announced by IEBC was never disputed.”

“Number of votes I obtained as a candidate were not contested. My government and I have been exonerated from any irregularities or illegalities. What does this imply?”

He said the ball is squarely in IEBC’s court and Kenyans expect it to conduct credible and transparent polls.

“The people of Kenya will speak again and this time their voice will and must be heard.”

“The IEBC must conduct another election, Kenyans expect nothing more, nothing less from them,” Uhuru said.

His lawyers, Fred Ngatia and Ahmednasir Abdullahi have been studying the full judgment and are not satisfied with it.
