Jubilee, IEBC take different paths on Appeal’s Court ruling

President Uhuru Kenyatta led Jubilee Party is on a collision course with IEBC as they both take different stands on a ruling delivered on Friday by the Court of Appeal.

Five Appellate Judges upheld an earlier ruling by the High Court that Presidential results announced at constituency level would be final.

From the ruling; on one hand, IEBC maintains that it will not appeal the ruling by the Court of Appeal as many would expect.

“The Court of Appeal clarified on declaration of results. We are not appealing the decision,” read a tweet from IEBC on Saturday

The commission further maintained that it will ensure the credibility of August 8 polls.

However, Jubilee Party, on the other hand, has stated it will file an urgent appeal against the ruling.

Speaking on Saturday in Turkana where he was delivering relief food, Devolution CS Mwangi Kiunjuri said the ruling was a recipe for chaos.

He said: “It is as if the court wants to see this country on fire.”

Kiunjuri maintained that the ruling will create confusion during the polls and the aftermath will be election violence.

“We as Jubilee will not accept the Court of Appeal ruling,” added the CS.

He said the Court of Appeal in its ruling did not factor in that some of the constituency officers tasked with announcing Presidential results could be biased.

“If county returning officers work under instructions from either Jubilee or NASA and announce different results; IEBC will have no mandate to verify and alter them.”

This, he noted, forms the basis why IEBC was pushing to have its Chairman Wafula Chebukati announce the final Presidential results.
