NGO petitions Supreme Court to declare NASA leaders unfit to hold public office

A Non-Governmental Organization has filed a petition at the Supreme seeking declaration that opposition leader are unfit to hold public office.

The Institute for Democratic and Governance (IDEG) filed a petition at the Supreme Court accusing opposition leaders of causing chaos and violence occasioned in some parts of the country during the repeat Presidential election on October 26.

NASA leaders Raila Odinga, Kalonzo Musyoka, Moses Wetangula,  Musalia Mudavadi and James Orengo are respondents in the petition.

The NGO further argued NASA’s call to Kenyans to boycott October 26 repeat polls is an electoral offense as it infringes on the right of Kenyans to exercise their democratic right, voting.

Therefore, stated the suit, “The petitioner, therefore prays that a declaration that the respondents are jointly and severally liable for the loss and damages arising from the acts of violence and intimidation occasioned during the period of fresh presidential election.”

Besides this declaration by the Supreme Court, IDEG also wants the following declarations made by the apex court as listed by Citizen Digital:

  1. Declare that each of the four respondents jointly and severally committed election offences and engaged in serious electoral malpractices and or irregularities.
  2. Declare that the Respondents’ actions as outlined in this petition violated the rights of citizens under Article 38 of the Constitution.
  3. Make a declaration that the respondents are unfit to hold public office under Chapter 6 and Article 137 of the Constitution.
  4. Declare the respondents’ joint and severally liable for the loss and damage arising from the acts of violence and intimidation occasioned during the period for the fresh presidential election.

 

NASA brigade led by Raila Odinga asked its supporters to boycott the polls.

In parts of Nyanza, no voting took place due to voter apathy and intimidation of voters.

IEBC them resolved to announce Uhuru Kenyatta as the winner of the repeat polls citing that the votes from areas which did not vote in Nyanza could not affect the outcome of the final results announced.
