Kenyan model sues KQ, advertising firm for use of her images without pay, approval

A Kenyan model has sued WPP-Scan Group and Kenya Airways for allegedly using her image to advertise the airline without her approval, reports the Star.

The model, Purity Wangechi, said that the airline has been using her images in social media and also media platforms since 2011.

Wangechi noted her right to privacy has been infringed on and she feels offended.

“I want an order for compensation for violation of my rights and special damages for the unpaid years amounting to Sh324,000,” read a petition she has lodged with the court.

Wangechi also wants the court to issue an injunction against the two entities from advertising and assigning her image or pictures in any media or social platforms.

She explained that in 2007, she entered into a written contract with Lowe Scanad, now known as WWP-Scanad Group.

According to the contract, she was to model for Kenya Airways in a promotion campaign.

The company continued to use her image both locally and internationally to advertise KQ between February 2009 and October 2009.

In 2012, she paid a visit to Scand Group over renewal of her contract since they were still using it but she was turned away.

Last year, she made another visit seeking for a renewal of the contract because once again, her image was still in use but once again, she was turned away with the company telling her that they were not using any of her images and that she had signed a contract only renewable by perpetuity.

Further, Scanad told her KQ only pays for renewals when adverts run for a certain period of time agreed upon in the contract.

Scanad also noted that the contract she signed permitted the airline to use her images for advertisement for an unlimited period of time.
