Maina Kiai, Makau Mutua fight adverse mention in Ngunjiri’s petition against Maraga

New York based law scholar and Human rights activist Prof Makau Mutua and Maina Kiai have sought to be enjoined in a petition seeking removal of Chief Justice David Maraga.

Makau and Kiai want to be part of the petition filed with the Judicial Service Commission JSC by Nyeri Town MP Ngunjiri wambugu.

They argue that they were adversely mentioned in the petition.

They have since written to the JSC through their lawyer Waika Wanyoke, seeking audience to clear their names after accusations in the Ngunjiri petition that they tried to engineer a regime change.

“As you will note, the general tenor of the petition is to make serious, but unsubstantiated allegations against the Honourable Chief Justice by claiming that he is working in cahoots with certain individuals within the civil society with the intent of procuring regime change through judicial radicalization,” read the letter from Wanyoke to JSC according to the Star.

“Their admission into the petition will provide them, at the minimum, with some opportunity to recover some of their reputation because it will give them a chance to show malice, lies and malignancy on Wambugu’s part,” further read the letter dated September 20.

The two activists who are critics of Jubilee administration petitioned JSC against the withdrawal of the petition by the Nyeri MP.

Ngunjiri had petitioned JSC to investigate and remove Maraga from office on grounds of judicial misconduct.

He had said in his petition that the CJ was politically persuaded to nullify August 8 polls.

Last week on Friday, President Uhuru Kenyatta asked him to withdraw the petition.

He is yet to write formally to JSC for withdrawal of the petition.
