Former Chief Government Pathologist to be charged for stealing body organs

Former Chief Government Pathologists Dr Moses Njue is staring at a suit for allegedly stealing body organs.

The assistant Director of Public Prosecution C. M Mwaniki directed he be arrested and prosecuted over the incident.

In the report by the Chief Prosecutor, Njue stands accused of stealing body parts belonging to Benedict Karau who died on March2, 2015.

Njue resigned from the position a few years back to start his own medical school.

Three charges- theft contrary to Section 275 of the penal code, willful destruction of evidence and illegal removal of body parts contrary to the Anatomy Act have been preferred on him.

“In regard to the missing body organ (s) you are directed to arrest Dr Moses Njue and cause him to be charged with the following offences,” read part of the DPP’s report according to Nairobi News.

The Kenya Medical Practitioners and Dentist Board is investigating the matter. Karau’s family, through his son Charles Mwongela lodged a complaint.

Karau, a polygamous man died after choking on food according to his youngest wife Martha Gakou.

His family requested for a post-mortem to establish real cause of death. Gakou said she would hire a private pathologist to represent her and hired Dr Njue who was present the Consolata Mission Hospital where the autopsy was carried out on March 12, 2015.

The report was he died of heart attack and that his body had been embalmed on the night it was taken to the mortuary. It also had bruises and injuries on the head and on the hands.

Though he was buried, Mwongela felt the report did not give a clear indication of the cause of his father’s death. He filed for exhumation in August in bid to have fresh autopsy conducted by Chief Government Pathologist Dr Johansen Oduor .

The second autopsy revealed that the heart, one kidney and other vital parts were missing. Dr Oduor said it was difficult to establish cause of death without the heart.

Dr. Njue confessed to having taken away he heart for further tests, ‘histology’. The family said Dr. Njue did not inform them of this.

John Gathenya, a mortuary attendant said he was asked to get containers to carry the organs.
