I need special treatment in my remand cell, says Deya

By Pharis Kinyua

Controversial UK based televangelist Gilbert Deya has protested “inhuman” conditions inside Kamiti Maximum Prison where he was remanded.

Appearing before Chief Magistrate Francis Andayi on Thursday to hear a ruling on his bail determination, Deya through his lawyer decried bad condition at the remand prison.

Through his lawyer John Sakwa, he said the conditions were pathetic.

Sakwa told the magistrate that during his extradition, the UK and Kenya agreed that his client would subjected to humane conditions but that is yet to happen.

Sakwa told the court that for instance, Deya is not allowed to leave his cell after 7pm and he is forced to relieve himself on a bucket which remains in his cell until morning.

Further, stated Sakwa as Nairobi News reports “he is made to wash the bucket with his bare hands.”

Sakwa also told the court the cell is dirty and full of bugs.

“The single room cell is extremely dirty and the mattress has bugs which have been biting my client since August 4.”

He said that prison authorities have told him that what he has is the best available.

“Prison authorities have told him that what he has been given is the best available.”

The lawyer told the court that it was prudent for his client to be granted bail.

Sakwa said that Deya was able to meet all bail conditions set in Britain when his extradition case was ongoing and he would do it here in Kenya.

“He will comply with any conditions if freed on bail in Kenya,” Sakwa told the court.

Nicholas Mutuku who appeared for the Director of Public Prosecution said though Kenya and Britain agreed on some conditions including his housing on a special unit at the Kamiti Prison, Deya would be treated like any other inmate.

He was extradited to Kenya on August 4 and was remanded for six days awaiting bail determination by the Magistrate. He is facing child trafficking charges.

“What he was promised was a single cell which he would occupy alone if remanded. The same applies to him if he is imprisoned,” said Mutuku.
