Paul Ongili-popularly known as Babu Owino charged with subversion, could face 7yrs in prison

Embakasi East MP Babu Owino, was on Tuesday charged with two counts of subversion and uttering abusive words against the President of Kenya.

The prosecution requested the court to deny bail to Mr. Paul Ongili-popularly known as Babu Owino, arguing that he has four previous charges of that nature.

Prosecutors Nicholas Mutuku and Catherine Mwaniki told the court that the defendant has no specified home, and he might easily find a way to hide. They also argued that he’s an influential person and there were protests demanding his arrest which may be reignited by his release on bail.

According to Babu’s charge sheet, he violated section 77 of the penal code which says that: “Any person who does or attempts to do, or makes any preparation to do, or conspires with any person to do, any act with a subversive intention, or utters any words with a subversive intention, is guilty of an offence and is liable to imprisonment for a term not exceeding seven years”.

Owino is said to have made the statement at a rally in Kawangware on Sunday, where he allegedly called the president ”mtoto wa mbwa”, and also likened the process of removing Uhuru to that of Gadafi, Gbagbo and others who were removed by the masses.

Babu was arrested by officers from the Directorate of Criminal Investigations and taken to Milimani Court where he denied charges of subversion. He was held awaiting bail decision on Wednesday.
