Lawyer petitions Parliament to remove Maraga, Mwilu from JSC

A lawyer has petitioned Parliament to remove Chief Justice David Maraga, DCJ Philomena Mwilu and five other members of the Judicial Service Commission over gross misconduct.

Lawyer Adrian Njenga in his petition to the National Assembly cites that Mohammed Warsame, Aggrey Muchelule, Tom Ojienda, Emily Ominde, and Mercy Deche are unfit to hold office due to the violations committee against the Constitution.

“The aforementioned have failed to promote and facilitate the independence and accountability of the Judiciary and the transparent administration of justice,” Njenga noted in his petition according to the Star.

He said the seven including the CJ and DCJ have “shielded, protected and exonerated” Judges who have been found culpable of misconduct.

“They have without any constitutional regard or justification dismissed petitions presented to the JSC,” quips the lawyer.

This is the second petition seeking removal of the CJ and some of JSC members.

Last year after the nullification of the August 8 polls, Nyeri Town MP Ngunjiri Wambugu filed a similar petition but withdrew it.

President Uhuru Kenyatta asked him to drop the petition.

The petition by Njenga comes amid radical changes in the Judiciary in the past two weeks after the resignation of Attorney General Prof Githu Muigai.

The President also nominated three new members to JSC to replace the AG and PSC Chair Prof Margaret Kobia who was appointed as the CS for Public Service and Gender.
