Court issues new orders ahead of Miguna’s return

The High Court in Nairobi has directed the outgoing Immigration boss Gordon Kihalangwa to travel documents to lawyer Miguna Miguna to facilitate his return to Kenya.

Justice John Mativo on Monday said failure by the Immigration department to do so; Miguna will be at liberty to use his Canadian passport to return to the country.

“Issue him with the travel documents and he should be allowed to Kenya on a day he chooses and to remain within the country until his petition his heard and determined,” the Judge ruled.

He also directed that the orders be served “in the Standard and the Nation Newspapers.”

His lawyers James Orengo and Nelson Havi welcomed Judge Mativo’s ruling saying they have faith that there is justice in the Constitution of Kenya.

Last week, Judge Luka Kimaru ruled that Miguna’s deportation was null and void.

He directed Kihalangwa to lodge Miguna’s passport with the Court registrar.

The immigration boss complied with the order but Miguna’s passport was defaced and he is required to apply a new one.

Miguna was deported to Canada on February 6 over his involvement with the unofficial inauguration of Raila Odinga as the “People’s President”.

On Saturday, Miguna announced he will return to Nairobi on March 26 after a tour in Europe beginning March 2 to popularize the National Resistance Movement (NRM).
