Raila loses lifestyle audit bid on Waiguru

The High Court has thrown out a plea filed by NASA boss Raila Odinga compelling Kirinyaga Governor Anne Waiguru to carry out a lifestyle audit.

Raila filed the plea to counter a defamation case lodged against him by the former Devolution CS.

In his plea, Raila said Waiguru should provide information on her lifestyle so as to enable him respond to the defamation suit appropriately.

But High Court judge Joseph Sergon in his directive noted that though Waiguru did not respond to some questions raised by Raila though his lawyer, she gave a satisfying reason for it.

“I am satisfied that Ms Waiguru responded to the interrogatories in accordance with the law,” said the judge.

Raila had among other things asked Waiguru to disclose her salary, allowances, properties she owns and her overall net worth.

With the information, Raila would respond accordingly to the defamation suit filed by the Governor for linking her to loss of sh1.6 billion at the National Youth Service.

In objection to answering the questions raised by Raila, Waiguru said they were unnecessary and unreasonable.

The Governor has also sued Kakamega and Machakos Senators Bonny Khalwale and Johnstone Muthama respectively over utterances they made linking her to the NYS grand theft.

In court papers, Waiguru argues that the two imputed improper notions during a Cord rally at Uhuru Park in November 2015.

She says they made statements alluding to the fact that she may have received the millions of shillings from the theft.

In their response as reported by Daily Nation, the two former Senators states that Waiguru was not forthcoming to the public and government about the heist.

They also rope in NYS suspect, Josephine Kabura saying that she has clearly given the role of Waiguru in the NYS theft in her affidavit.
