TJ Kajwang faces life imprisonment or death sentence for ‘swearing-in’ Raila

Ruaraka MP TJ Kajwang could be staring at charges attracting a death sentence or life imprisonment after he administered oath of office to Raila Odinga as the “People’s President” on Tuesday.

The MP, a lawyer by profession and an ODM die-hard, was arrested on Wednesday by officers drawn from the Flying Squad unit.

He was whisked to DCI headquarters along Kiambu Road for questioning before he is arraigned at Milimani Law Courts today.

According to Nairobi News, the state will premise their charges under Section 59 and 60 of the Penal Code where illegal oaths fall in.

Section 59 of the Penal Code is clear that anyone found guilty of administering a false oath is liable to punishment by death.

“Any person who is present at, and consents to administering, of any oath, or engagement in the nature of an oath, purporting to bind the person who takes it to commit any offence punishable by death; or takes any such oath or engagement, not compelled to do so, is guilty of a felony and is liable to imprisonment for life,” reads Section 59 of the Penal Code.

Section 60 of the same adds: “Any person who administers an oath, or engagement in the nature of an oath, purporting to bind the person who takes it to commit any offence punishable with death; is guilty of a felony and shall be sentenced to death.”
