Matiang’i, Boinnet, Kihalangwa could go to jail

Interior Cabinet Secretary Dr. Fred Matiang’i, the Inspector General of Police Joseph Boinnet and Immigration PS Gordon Kihalangwa are on sharp focus by the Judiciary.

The three are staring at a prison sentence.

They have since February 2, 2018 when NASA activist and self-proclaimed NRM ‘general’ Miguna Miguna was first arrested, defied 4 court orders relating to his case.

Yesterday, High Court Judge George Odunga issued precise and firm orders that Miguna be released from his detention cell at JKIA Terminal 2 after being held for close to 72 hours since his arrival in Kenya on Monday.

But yet in another show of brazen disobedience to court orders, the state went ahead to deport Miguna back to Canada on Wednesday at 11:19pm.

Odunga had summoned the CS, the IG and Immigration PS on Thursday in his chambers for sentencing.

“This court cannot continue to fold its arms while the respondents continue to catwalk on its orders,” said the judge ordering the three to appear before him at 10am today for sentencing.

Before Odunga’s orders, on Tuesday, Justice Roselyne Aburili had issued an order for the immediate release of Miguna Miguna but it was also defied by the state.

When the state first defied court orders issued by Justice Luka Kimaru in regard to Miguna’s case when he was detained for five days before his first deportation, Chief Justice David Maraga said court orders must be obeyed by everyone regardless of who they are.

“The recent disregard of court orders is an act that is not only inimical to the rule of law but also completely at odds with Kenyans’ constitutional rights.

“To disobey a court order is not only a violation of the constitution but also dereliction of public duty,” said the CJ.
