Aukot applies as an interested party in petition challenging Uhuru’s victory

Thirdway Alliance Presidential candidate Dr Ekuru Aukot has applied to be enjoined in the petition challenging President Uhuru Kenyatta’s victory.

He is among the candidates who participated in the repeat presidential polls following nullification of August 8 polls.

He came a distant third after Uhuru and Raila Odinga.

Raila’s name was still in the ballot papers despite his withdrawal.

Aukot has filed his application at the Supreme Court as an interested party in the petition separately field by Njonjo Mue, Khelef Khalifa and former Kilome MP Harun Mwau.

The two petitioners have asked the Supreme Court to nullify the polls on a number of issues.

Mue in particular argues that IEBC did not conduct fresh nominations as prescribed by the law which renders the election illegal and illegitimate.

He also says in his court pleadings that after Raila’s withdrawal, IEBC should have cancelled the elections but it went ahead to conduct the polls.

Mwau has a separate but similar argument to Mue’s.

Aukot through his lawyer argue that the outcome of his results was greatly affected by the issues raised.

“Since the petition by Njonjo Mue is principally on whether there ought to have been fresh nominations, it is prudent that I am enjoined,” he says according to the Star.

Further, states Aukot, he says he can give a bearing to the court on issues pertaining to the case, nomination of candidates being among them.

Before the repeat Presidential poll, Aukot moved to the High Court where he challenged IEBC’s move to lock out other Presidential candidates who had contested on August 8.

Justice John Mativo Court ruled in his favour and allowed five other candidates to join the repeat presidential race.
