High Court nullifies Miguna’s deportation,terms it null and void

The High Court in Nairobi has nullified the deportation of self-styled NASA activist lawyer Miguna Miguna.

On Thursday, the High Court ruled that his deportation was null and void.

Justice Luka Kimaru said his deportation lacks merit and is null and void.

He further directed the Immigration department to deposit Miguna’s passport with the registrar of the court within seven days.

According to Nairobi News, the Judge in his ruling cited that the deportation happened even as the Inspector General of Police Joseph Boinnet and DCI Boss disobeyed court orders to present Miguna in court.

In celebration of the ruling, Miguna who was deported to Canada wrote via twitter: “We, the NRMKe, Kenyan patriots and freedom fighters, believe in and are fully committed to the rule of law. Thanks and congratulations, Counsel. I’m grateful for the work.”

His lawyers Nelson Havi and John Khaminwa have put up a brave fight to fight the deportation order.

Yesterday, the Judge had maintained that the deportation of Miguna was still in force pending hearing arguments by the Attorney General in regard to the matter.

Migunawas caught up in the battle between NASA and Jubilee regime when he actively took part in swearing-in Raila Odinga at Uhuru Park on January 30 as the People’s President.

He was arrested two days later at his Runda home and taken to court where he was released on Sh50, 000 bond.

But he was not released. He was taken to Githunguri Police Station where he spent the night before being moved the following day to Lari Police Station.

His lawyers protested this but it seemingly fell on deaf ears. He never appeared in Court the following week on Monday prompting the Judge to summon Boinnet and Kinoti who never showed up.

Miguna was later charged the following day at Kajiado Law Courts where he declined to take plea. He was deported the same night to Canada.

On his arrival, he vowed to fight the “despots”-a term he has used severally to describe President Uhuru Kenyatta’s  regime.
