Judge quashes application seeking extradition of Kenyan lawyer to ICC

High Court Judge Luka Kimaru has dismissed an application by the Office of the Director of Public Prosecution seeking to extradite a Kenyan lawyer to the ICC.

The judge on Thursday in his ruling cited that the application by the DPP Keriako Tobiko does not meet certain international conditions for the extradition of Paul Gicheru.

Gicheru is wanted by the ICC for witness tampering and bribery which led to dismissal of crimes against humanity against President Uhuru Kenyatta and DP William Ruto.

“The application filed by the Office of the Director of Public Prosecution on May 28, 2015 lacks merit and cannot stand,” said justice Kimaru as quoted by the Star.

An order for his arrested was also lifted.

The ICC issued the warrants of arrest for Gicheru and another lawyer, Philip Kipkoech in March 2015.

The court alleged that between April and September 2013, the two tried to bribe six witnesses testifying against Uhuru and Ruto.

This is a punishable offence as prescribed by Article 70 of the Rome Statute.
