Government to appeal Miguna’s deportation ruling, says Interior PS

Government will appeal a ruling made by the High Court on Thursday nullifying the deportation of self-styled NRM ‘general’ Miguna Miguna.

Judge Luka Kimaru in his ruling said Miguna was illegally deported because it came at a time when the Inspector General of Police Joseph Boinett and DCI boss George Kinoti defied court orders during an ongoing case concerning the lawyer.

He termed the deportation as “null and void”.

The Judge also directed the Immigration department to surrender Miguna’s passport with the court registrar.

However, moments after the ruling, Interior Principal Secretary Eng Karanja Kibicho said government will appeal the ruling because it is not in the best interest of the country.

“As much as the government respects the court’s decision, it still holds its earlier stated view that the deportation of Miguna was procedural and in accordance to the law,” said the PS as quoted by the Star.

“The government’s legal team is reviewing the High Court order and will shortly be appealing the court decision,” added he.

On the directive requiring Immigration department to surrender Miguna’s passport, Kibicho said it was a directive against the interest of the country.

Miguna had earlier celebrated the ruling thanking his legal team for putting up a brave face in fighting for his rights.
