Faces of election petition losers ordered to pay Sh141M in total costs

Election petition losers whose cases have been determined by the courts already have been slapped with hefty costs totaling to Sh141.5 million.

A total of 277 people filed elections petitions after the August 8 polls last year.

This money will be paid out to the IEBC, lawyers and respondents.

It is believed that Supreme Court’s landmark ruling which nullified the August elections encouraged disgruntled quarters to file election petitions.

Below is a breakdown of some of the cases that have been heard and determined and dismissed with exorbitant costs according to Nairobi News.

Laikipia Governor: Sammy Waity Ndungu (12M)

Justice Mary Kasango upheld the election of Governor Nderitu Muriithi and ordered the petitioner, Ndungu to pay Sh12 million in costs

Busia Governor: Voter Peter Odima (Sh12m)

Justice Kiarie Waweru upheld the election of Governor Sospeter Ojamong and ordered the petitioner, Odima from Nambale to foot the cost.

Kirinyaga Governor: Martha Karua (10m)

The Narc Kenya Party boss contested against Jubilee’s Anne Mumbi Waiguru who won the elections. Her case was dismissed by the Judge Lucy Gitari of Kirinyaga High Court with a cost of Sh10 million. She has appealed the ruling at the Court of Appeal in Nyeri.

Machakos Governor: Wavinya Ndeti (10m)

Justice Aggrey Muchelule upheld the election of Maendeleo Chap Chap’s Governor Alfred Mutua. He ordered Wiper’s Wavinya Ndeti to pay Sh10 million in costs.

Trans Nzoia Governor: Voters Robinson Simiyu and Alpha Kitai (10m)

Justice Antony Mrima upheld the election of Governor Patrick Khaemba which had been challenged by voters Simiyu and Kitai. He ordered they pay Sh10 million in costs.

Mombasa Governor: Hassan Omar (8m)

Justice Lydia Achode of the Mombasa High Court upheld the election of Governor Hassan Joho and ordered Omar to pay Sh8 million in costs.

Nyali MP: Said Abdalla (7m)

Justice Lydia Achode of the Mombasa High Court ruled that Mohammed Ali’s election as Nyali MP was conducted according to the law. She ordered Said to pay Sh7 million in cost.

Kitutu Masaba MP: Timothy Bosire

Former MP Timothy Bosire had challenged the election of Shadrack Mose but the court upheld his victory. He was ordered to pay Sh5 million in costs.
