Jaguar moves to court seeking orders to stop polling in Nyanza

Starehe MP Charles Kanyi Njagua has moved to court to block repeat vote scheduled for Saturday in Kisumu, Siaya, Homa Bay and Migori counties respectively.

The MP who is a singer under the name Jaguar said the polls should not take place on Saturday because they will not change the numbers President Uhuru Kenyatta already has.

IEBC Chairman Wafula Chebukati on Thursday announced repeat polls in the four areas would be conducted on Saturday.

Yesterday (Thursday), the polls did not kick off in some of these areas for various reasons all bordering on security of IEBC officials.

Jaguar in court papers argues IEBC should be compelled to announce the results of the Presidential election without the results from the four counties.

“The numbers there cannot change the total votes Uhuru Kenyatta has garnered,” states the MP in court papers as quoted by the Star.

He adds: “IEBC should not waste money organizing a repeat election for people who have clearly said they will not vote, so we will also be helping innocent people from being subjected to unending turmoil. [They can instead] continue with their lives and open businesses in the area.”

The Starehe legislator wants the court to seven days given to IEBC to announce the winner of the polls counted from October26 and not October 28 “or any other day”.

Those sued in the suit are IEBC and Chairman Wafula Chebukati. The case is before High Court Judge John Mativo who ordered that respondents be served before returning to court on Monday.

However, even as Jaguar seeks court orders to stop repeat polls in the four counties, NASA leader Raila Odinga has asked his followers to boycott polling.

In an interview on Citizen TV Friday, Raila said conducting Saturday’s poll in Nyanza was a waste of time.

He said holding election in the four counties only was ethnic profiling which is not right.

Nyanza clerics have also told off the IEBC on what they have termed as profiling of the Luo community.
